Clifton’s Auto Repairs Ltd

Terms and Conditions of Service

Version: 21 October 2026

1 Who we are

We are Clifton’s Auto Repairs Ltd, company number 08958597, at 164 Plato Road, Brixton, London SW2 5UP. We specialise in BMW and MINI servicing, diagnostics and repairs.

Telephone: 020 7924 0201. Email: clif_autos@yahoo.co.uk. Website: https://www.cliftonautorepairs.com. VAT registration number: GB 216171534.

These terms cover work we agree to carry out on your vehicle and parts we supply as part of that work. We will provide or make these terms available before you authorise work. Your job-specific quote, estimate and recorded authorisation form part of our agreement. Nothing in these terms removes your legal rights.

2 Booking and authority

Please give us your current name, address, telephone number, email address, registration and the faults or work you want investigated. Tell us about warning lights, previous repairs, modifications, accident or water damage, relevant warranty cover and any known safety risks.

You confirm that you own the vehicle or have the owner’s permission to authorise the work. Tell us who else may approve work or collect the vehicle for you. We will record the agreed work and spending limit, and your approval by job card, text, email or a recorded note of a telephone conversation. We will not treat leaving your vehicle with us as unlimited authority to carry out chargeable work.

3 Prices and estimates

Prices quoted to consumers include VAT. A quote is a fixed price for the work described, valid for 14 days unless a different period is stated. Once accepted within its validity period, it will not increase for that work.

An estimate is our reasonable assessment of the likely cost based on the information available. If we find additional work is needed or expect to exceed your approved total, we will explain the findings and obtain your approval for the revised work and price before proceeding. A pre-agreed spending limit allows work only within its agreed scope and amount.

If you do not approve further work, you pay for work already authorised and properly carried out. We will explain any necessary reassembly, transport or storage arrangements and agree any additional charges before they are incurred. An agreed strip-down price will state whether reassembly is included.

4 Diagnostics and investigation

Our diagnostic rate is £120 per hour including VAT (£100 plus VAT). Before beginning diagnosis, we will agree a time or money limit with you. Our usual initial limit is one hour, costing up to £120 including VAT; it applies only when you approve it. We will obtain further approval before exceeding that limit.

Diagnosis may include fault-code reading, live-data checks, electrical or mechanical tests, road testing and reasonable inspection. More extensive dismantling, specialist testing or programming will be identified and agreed separately where required.

Diagnostic charges pay for the investigation performed with reasonable care and skill; they are payable even if you decline the repair. A fault code does not necessarily identify a failed part. Intermittent, multiple or previously concealed faults may require further investigation. We cannot promise that every fault will be identified within the first hour. This does not excuse incorrect work or a failure to use reasonable care and skill.

5 Additional work and timescales

We will not carry out additional chargeable work without your approval, except work already covered by your agreed scope and spending limit. If we cannot reach you, we will normally pause the affected work.

We will give an expected completion time and tell you about material delays. Unless expressly agreed as a firm deadline, completion dates are estimates. We will perform the work within the agreed time or, if none is agreed, within a reasonable time. If a delay becomes substantial, we will discuss your options, including any cancellation rights you have.

6 Parts we supply

We will identify the type of parts included in our quote or estimate: genuine BMW/MINI, another original-equipment manufacturer’s part, aftermarket, reconditioned or used. We will discuss alternatives where available and suitable. We will only fit used or reconditioned parts with your agreement. We will not describe an alternative part as equivalent unless there is a reasonable basis for doing so.

Parts are charged at our quoted retail prices, which may include sourcing, handling and the warranty support we provide. We are responsible for ensuring that parts we supply meet applicable legal requirements. A manufacturer’s warranty does not replace your rights against us.

If you want replaced parts returned, tell us when authorising the work. We will explain if they must be returned under an exchange or warranty arrangement, or cannot lawfully or safely be handed back. Any exchange surcharge will be explained before you approve it.

7 Customer supplied parts

We may decline to fit customer-supplied parts if we reasonably consider them unsuitable, unsafe or incompatible. If we agree to fit them, our agreed labour charges apply and we remain responsible for our workmanship. We do not provide a parts warranty on a part we did not supply, or accept responsibility for defects in it that we did not cause.

If a supplied part is unsuitable or fails, further diagnosis, removal or replacement may be chargeable if the problem is unrelated to our work. We will explain and obtain approval before carrying out additional chargeable work. We remain responsible if we damage the part or fit it incorrectly through a failure to use reasonable care and skill.

8 Seized components and locking wheel nuts

Age, corrosion, previous repairs and seized fixings can complicate dismantling. We will use reasonable care and skill and tell you about foreseeable material risks. If extra work or replacement components become necessary, we will obtain your approval before incurring additional charges. You do not automatically bear the cost of damage caused by our negligence.

Please supply the correct locking wheel nut key and tell us its location. If it is missing, damaged or ineffective, we will explain the options, risks and price before attempting specialist or destructive removal.

9 Coding and software programming

We will explain the proposed coding or programming, its price and any known material risks before obtaining your approval. We will check and support battery voltage where appropriate and follow suitable procedures.

Pre-existing electrical faults, incompatible or modified software and defective control units can affect the outcome. We will tell you if further investigation or hardware is needed and obtain approval for additional charges. Where relevant, we will explain that updates may reset settings or affect existing non-standard coding.

We are not responsible for unrelated pre-existing defects merely because they become apparent during programming. We remain responsible for damage or failure caused by our work, parts or failure to use reasonable care and skill. This clause is not a blanket exclusion for interrupted programming, low voltage or failed control units.

10 MOT work and safety

Where an MOT is booked through us, we will explain the test fee and whether testing is performed at our premises or by another authorised test station. An MOT is a statutory inspection at the time of testing, not a service or a guarantee of the vehicle’s continuing condition.

An MOT failure does not authorise repairs. We will explain the findings and obtain approval for repair work. We will warn you about dangerous defects and discuss safe transport. You must not drive a vehicle on the road unless it is lawful and safe to do so.

11 Electric and hybrid vehicles

We will accept electric or hybrid work only where we have the appropriate capability, equipment and arrangements. Please disclose known high-voltage battery damage, flooding, collision damage, overheating or battery warnings before delivery.

We may need to isolate the high-voltage system or arrange specialist assessment before proceeding safely. We will explain any additional charge or external work and obtain your approval. Our acceptance of one type of work does not mean we offer all high-voltage or battery repairs.

12 Road testing and vehicle care

When reasonably necessary for the work you authorise, we may road-test the vehicle or move it between our premises and an agreed specialist or MOT station. We will use appropriately authorised drivers and suitable insurance arrangements. We will obtain agreement before subcontracting material work and remain responsible for work we arrange under our contract, subject to your legal rights.

We will look after your vehicle and keys with reasonable care while in our custody. We are responsible for loss or damage caused by our negligence. We may record mileage, fuel level and visible condition and take photographs needed for diagnosis, work records or a dispute. Marketing use requires separate permission where appropriate.

Please remove valuables and child seats or equipment that may obstruct agreed work. We are not responsible for unrelated loss we did not cause, but this does not exclude liability for our negligence.

13 Collection and delivery

Collection, delivery, recovery, towing and courtesy vehicles are not automatically included in a booking. Any service we agree to provide will have its availability, price and arrangements confirmed separately before you accept it. We will not promise a service we cannot provide.

Please arrange collection promptly once we tell you the vehicle is ready. Tell us who is authorised to collect it; we may request identification or confirmation before handing over the vehicle and keys.

14 Out of hours drop off and key handover

Out-of-hours drop-off or collection must be agreed in advance. We will give you instructions for parking and handing over keys and explain when custody transfers. We will not exclude our responsibility merely because the vehicle has not yet been entered into our booking system.

We will leave keys or a vehicle with a neighbour or another named person only on your specific instructions, preferably by text or email, and will record the handover. After a correct handover under your instructions, that person is responsible for subsequent safekeeping, without affecting our liability for our earlier negligence or an incorrect handover.

15 Warranty company and insurer work

Tell us before work starts if you want a warranty provider or insurer to contribute. Claim preparation may require chargeable diagnosis or dismantling, which you must approve separately. We will seek the provider’s authorisation before carrying out repairs intended to be covered by the claim.

We will explain any excess, excluded work or shortfall between the provider’s approved rates and our prices, and obtain your approval for your contribution before proceeding. The provider’s approval is not your approval of an undisclosed shortfall.

Unless we expressly agree that the provider alone is responsible for payment, you remain responsible for charges you have authorised if the provider refuses or fails to pay them. We will keep you informed about claim decisions that affect the work or your costs.

16 Deposits and payment

We may request a deposit for substantial jobs or parts orders. We will confirm its amount, purpose and cancellation arrangements before payment. It is credited against your bill and is not automatically non-refundable.

Unless we agree credit terms in writing, payment is due when work is completed and before collection. We accept cash, debit and credit cards, and bank transfer. We do not add a surcharge for card payments. We will give you an itemised invoice showing applicable VAT. Bank-transfer details will be provided on the invoice. Independently telephone us on our established number to verify any unexpected message changing payment details.

If you dispute an invoice, contact us promptly so we can investigate. We will explain our position and any amount not in dispute. We will not impose an unspecified administration or late-payment fee under these terms.

17 Cancellation where a statutory cooling off right applies

There is no automatic statutory 14-day change-of-mind period for a contract agreed at our premises. This does not affect your rights if our work or parts are faulty, or any other legal right to cancel.

Where you enter a qualifying distance or off-premises contract, you generally have 14 days to cancel a service contract from the day after it is made, without giving a reason. Whether this applies depends on how the contract is formed; merely arranging an appointment by telephone or having a vehicle collected does not determine it. We will give you the applicable cancellation information before you are bound and confirm it in a durable form such as email or paper.

You may cancel by a clear statement by telephone, email or post using our contact details above, or use the cancellation form below. You do not have to use the form. For contracts involving goods, we will provide any different cancellation period, return arrangements and applicable information before the contract is made.

If you want services to start within the cancellation period, we will obtain your express request first, on a durable medium where required. If you then cancel, you may have to pay a proportionate amount for services properly supplied up to cancellation, but only where the legal conditions for charging are met.

You lose the service cancellation right after full performance only where you expressly requested an early start and acknowledged beforehand that this would happen. Asking for work to start does not by itself remove your cancellation right immediately.

We will not automatically charge a supplier restocking fee, retain a deposit or treat a standard vehicle-specific parts order as bespoke in order to override statutory cancellation rights. Any exception for genuinely personalised goods or expressly requested urgent off-premises repairs applies only where its legal conditions are met and will be explained. Refunds will be made within the applicable legal deadline, generally within 14 days of cancellation for services, using the original payment method unless otherwise agreed without a fee.

18 Other cancellations and parts orders

Please tell us as soon as possible if you need to cancel or rearrange. Outside an applicable statutory cancellation right, you must pay for authorised work already properly performed. Any further cancellation charge must be fair and reflect actual net loss directly caused by cancellation, taking account of costs saved, refunds, resale and reasonable steps to reduce loss. We will explain and evidence the calculation and will not recover the same loss twice.

We will explain a material non-returnable parts commitment before ordering and obtain your approval. A supplier’s refusal to accept a return does not automatically make every charge lawful. Any unused deposit balance will be refunded. No separate missed-appointment fee applies under these terms unless a fair, clearly priced arrangement was separately agreed before booking, without overriding legal cancellation rights.

19 Storage

Once we notify you that your vehicle is ready and available for collection, the first five working days are free of storage charges. Working days mean Monday to Friday excluding English bank holidays; counting begins on the next working day after notification. If the vehicle remains, storage is £30 per calendar day including VAT (£25 plus VAT), beginning on the calendar day after the fifth working day. We will give you the exact start date and a reminder before charging.

Storage applies only where this policy was clearly brought to your attention and agreed before the relevant contract. We will discuss reasonable arrangements where you cannot collect, and will not charge for delay caused by us, including time we reasonably need to investigate or correct our own defective work. This clause does not retrospectively authorise charges for vehicles already with us. A repairer’s lien does not itself authorise storage charges. We will not apply this daily storage charge for a period during which we refuse to release the vehicle in reliance on a lien. We will not use storage charges to penalise a customer for raising a complaint.

20 Retaining vehicles, returning vehicles and selling uncollected vehicles

We may exercise a lawful repairer’s lien where it applies to retain a vehicle for unpaid charges for work on it. These terms do not create an unrestricted right to keep a vehicle for unrelated debts or automatically extend a lien to storage charges.

When handing back your vehicle, we will provide an itemised invoice and explain any remaining faults or safety concerns. We will release it to you or your authorised collector once payment arrangements and any lawful right of retention have been resolved. Collection by transporter may be necessary if it is unsafe or unlawful to drive.

If your vehicle remains uncollected, we will try to contact you and write to your last known address, asking you to collect or agree arrangements and settle lawful charges. Our initial written request will normally allow at least 14 calendar days to respond. This initial deadline is not a notice that we can sell the vehicle after 14 days.

Before considering sale, we will take reasonable steps to establish ownership and any finance, lease or other third-party interest. A vehicle does not become our property merely because it has been left with us. We will obtain case-specific legal advice before commencing any sale procedure.

We may sell an uncollected vehicle only where legally entitled under the Torts (Interference with Goods) Act 1977 after completing the applicable notice procedure, or under an appropriate court order. Our right to retain a vehicle does not itself authorise sale, scrapping or use of it.

Where relying on the statutory notice procedure, the written notice of intention to sell will identify us, the vehicle, where it is held, the relevant amount due and the date on or after which sale is proposed. It will be sent by registered letter or recorded-delivery post as required by the Act. We will allow a reasonable opportunity to collect and, where money became due before the sale notice was given, at least three months between giving that notice and the proposed sale date. This period does not run simply from arrival, completion of repairs or our first reminder.

We will not give a statutory notice of intention to sell, or sell pursuant to it, while we have notice that, because of a dispute concerning the vehicle, you are questioning or refusing to pay all or part of what we claim is due. We will seek resolution or appropriate court directions. Any court-ordered sale will follow the order.

If a lawful sale proceeds, we will adopt the best method of sale reasonably available in the circumstances, retain sale and valuation records, and account to the person entitled for the proceeds after only lawful deductions and sale costs. We will provide a written account and return any surplus to the person entitled. We will continue taking reasonable care of the vehicle while it remains in our custody.

21 Our workmanship and parts warranty

We warrant our workmanship and new parts supplied and fitted by us for 12 months or 12,000 miles from completion, whichever occurs first. Where a defect is covered by this warranty, we will rectify it without charge for the covered parts and necessary labour. We will identify any separately agreed commercial warranty for used or reconditioned parts before you approve the work. Any longer manufacturer’s guarantee will be explained where applicable.

This additional warranty covers defects in our workmanship and covered parts. It does not cover normal wear, unrelated faults, misuse or damage caused by subsequent third-party work. Exclusions for overheating, oil starvation, coolant loss, low voltage or failure of another component apply only where the problem was not caused or contributed to by our work, supplied parts or failure to use reasonable care and skill.

Contact us promptly if a problem occurs and give us a reasonable opportunity to inspect and put it right. Stop using the vehicle if continuing is likely to be unsafe or cause further damage. If you are far away or urgent action is necessary, contact us as soon as reasonably possible so we can agree a practical solution. Lack of prior permission does not automatically extinguish your legal rights or a valid claim for reasonable emergency costs.

This warranty is additional to your statutory rights. Its time and mileage limits do not limit those rights. Services must be carried out with reasonable care and skill. Where legally available, remedies include repeat performance at no cost, within a reasonable time and without significant inconvenience, or an appropriate price reduction. Parts we supply must meet legal standards, including satisfactory quality, fitness for purpose and description; goods remedies may include rejection, repair, replacement or a price reduction as the law provides. Other remedies, including damages where applicable, remain available.

22 Liability

We are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. Loss is foreseeable if it was an obvious consequence or both sides knew it might happen when the contract was made. Tell us before booking about particular circumstances that may materially affect the consequences of delay or failure.

We do not exclude or limit liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability or consumer right that cannot lawfully be excluded or limited. Nothing here makes you responsible for damage caused by our negligence.

Where work is ordered for business purposes, any separate business terms or liability limit must be expressly agreed and comply with applicable law. No blanket business liability cap is imposed by these terms.

23 Complaints and dispute resolution

Please contact Clifton Oddman using the contact details in clause 1, providing the registration, job or invoice number and the outcome you seek. We aim to acknowledge complaints within three working days and provide a substantive response within 14 calendar days. If more investigation is needed, we will explain why and give a further response date.

If we cannot resolve a complaint, we will provide our final response in a durable form and the details of an appropriate accredited alternative dispute resolution provider where required, stating whether we are obliged or prepared to participate. We will follow any scheme obligations that apply to us. This process does not prevent you seeking independent advice or exercising court rights.

24 Personal information

Clifton’s Auto Repairs Ltd is responsible for personal information we process about you. We use contact, vehicle, authorisation and payment records to arrange and perform work, communicate with you, administer payment, meet legal obligations and manage legitimate business interests such as complaints and security, subject to applicable data protection law.

We share information only where necessary and lawful, including with relevant garage-management and invoicing providers, authorised specialists, MOT providers or DVSA, professional advisers, and your insurer or warranty provider where appropriate. Marketing choices are handled separately; accepting these terms is not consent to marketing.

Our Privacy Notice, set out at the end of these terms and available on request, explains the legal bases, recipients, retention periods, your rights and how to complain to the ICO. These terms do not replace that notice.

25 Changes and governing law

The version supplied when you agree the work applies to that contract. Later website changes do not retrospectively alter it. Any agreed changes to a job will be recorded with your approval. If one provision is unenforceable, the rest continues so far as legally possible.

These terms are governed by English law. Consumers retain any mandatory protections and rights to bring proceedings in the courts of the part of the UK where they live. Business disputes are subject to the courts of England and Wales unless otherwise lawfully agreed.
